Article 1: Scope of application
These General Terms and Conditions (GTC) apply to all transactions between TradePowerFusion and its customers for the sale of its prop trading services, as well as for the sale of addons for the Ninja Trader platform.
Article 2: Object
The purpose of these Terms and Conditions is to define the terms and conditions under which TradePowerFusion provides its customers with prop trading services and addons for Ninja Trader.
Article 3: Access to services
The customer must have completed the form and paid the indicated amount to have access to the training and prop trading services. To purchase Ninja Trader add-ons, the customer must also follow the order process indicated on the TradePowerFusion website.
Article 4: Fees
The customer must pay an access fee to access TradePowerFusion's prop trading services. Fees may vary depending on the commission structure chosen. Details of fees are available on the TradePowerFusion website. For the purchase of Ninja Trader addons, prices are specified on the corresponding order page.
Article 5: Use of services
Customer agrees to use TradePowerFusion's prop trading services and Ninja Trader addons in a professional and ethical manner. The customer also agrees to comply with all laws and regulations applicable to their use of the prop trading services and addons.
Article 6: Liability
TradePowerFusion shall not be liable for any losses incurred by the customer in connection with the use of prop trading services or addons for Ninja Trader. The customer assumes full responsibility for trading decisions made. TradePowerFusion does not guarantee the profitability of the customer's trading.
Article 7: Termination
TradePowerFusion reserves the right to terminate the contract with the customer at any time and for any reason. In the event that the customer wishes to terminate the contract with TradePowerFusion, it must notify TradePowerFusion in writing.
Article 8: Intellectual property
TradePowerFusion's prop trading services and Ninja Trader addons, including software and documentation, are protected by copyright and are the exclusive property of TradePowerFusion. Any unauthorized reproduction or distribution of the prop trading services and addons is prohibited and will be prosecuted in accordance with applicable law.
Article 9: Privacy policy
The information collected from the customer is for the exclusive use of TradePowerFusion and will under no circumstances be passed on to third parties. The customer accepts that his data may be used for the purposes of evaluating and monitoring his trading performance.
Article 10: Applicable law
These terms and conditions are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before taking any legal action. Any dispute relating to the execution or interpretation of these GCS will be submitted to the competent courts.
